Powers of Entry Code to come into force in 2015

We previously reported in June that the Government was seeking to introduce the Powers of Entry Code 'this year'. However, the Home Office has now announced that it will not be introduced until 2015.

With regards implications for Licensing Authorities, the Code highlights that where it is appropriate to do so, reasonable notice (usually not less than 48 hours or as specified in relevant legislation) should normally be provided to the occupier or landowner of the intention to visit premises and/or undertake inspections where it is practicable to do so. It also provides guidance on the conduct of inspections.

A synopsis of the Draft Code published 22 January 2013 can be found in our article 'Powers of Entry Code to be introduced this year' which also contains a link to the Draft Code itself.

We shall of course update you as soon as we are aware of the actual implementation date.

Law correct at the date of publication.
